2nd conditional

I am confused about the use of the second conditional. I will be grateful if someone answers.

1. "If that were the rule, I could say that I am getting hurt by your attitude."
2. "If that were the rule, I could say that I was getting hurt by your attitude."

Which of them is correct? Please guide me about the tense that should be used in the main clause of the second conditional (after the infinitive verb). Thanks in advance .

2 has the formally correct concordance of tenses, but 1 would be considered acceptable by most contemporary speakers.
