"WAS yet to be" Vs "HAD yet to be"

Dear teachers,

Which of the following sentences is grammatical? (Should it be "was yet to be" or "had yet to be"). 

1. The secretary told the meeting that the director's instruction was yet to be complied with. 

2. The secretary told the meeting that the director's instruction had yet to be complied with.

Both possible, but 'had' more idiomatic.
